U.S. District Judge Audrey Collins recently awarded MySpace, a popular social networking interface, $230 million to conclude a staggering lawsuit against Sanford Wallace and Walter Rines after the two failed to appear in court. Wallace is notorious in anti spam and spam control circles as a, “Spam King,” and in May of 2006 was ordered to halt operations and pay a $4 million fine after exploiting susceptibilities in Microsoft Internet Web browser to distribute spyware. On May 12, 2008 he, along with Rines, was ordered to surrender $157.4 million in damages, an additional $1.5 million under California’s anti-phishing laws, and $4.7 million in attorney fees to MySpace. Moreover, Rines was fined $63.4 million under the 2003 CAN-SPAM Act which is responsible for placing restrictions upon commercial email. Both were subject to injunctions designed as spam blockers to prohibit additional malicious online activity. The case represents the largest recorded anti spam/unsolicited email lawsuit in history. MySpace reported a total of 735,925 unsolicited spam messages to its members under the guise of users’ “friends” and other seemingly legitimate sources.
